I submitted a copyright complaint on XXth July 2022, the related complaint ID is XXXX. This complaint is about seller (ID:XXX) used some pictures in his listing XXXXX from our website, the related product link below. ( https://wwwXXXXS) After I reported this ASIN, the complaint was accepted, the listing was unlisted. A day after, the seller contacted us through contact information I provided in the complaint(email: XXXX), and wrote a letter of apology to us, promised he will delete all infringing pictures. (see letter in attachment) After I received the letter, I reviewed the related ASIN, and found that there was no more infringed pictures. Hence, I submitted a complaint retraction request(case ID is XXXX) on X July. The retraction was accepted by Amazon, and the seller’s listing was reinstated. Recently, I found my report a violation function is revoked, I believe this complaint is the cause.
The measures I have taken.
I went through the Intellectual Property for Rights Owners.
I found that the pictures we used to report the other seller in the website, is not registered in US copyrighted office, even it is taken by us. When I report the images, not an entire ASIN, I should be only referring to the images for infringement, not the entire ASIN or product detail page. In the meantime, I should not include more than one ASIN in one complaint, I should separate all infringing ASINs in separated notice.
I also realized the contact email may be not valid, because the brand owner is not using it very frequently.
My business partner and I have been studying IP for right owners since then and have not use any brand registry benefits and functions until we are fully ready. To ensure we will not violate any policy in the future, we will only use our own copyrighted pictures, trademark, patent, own brand website in the brand registry, and we will not use any other methods except our own IP.
The future steps we are taking and will continue taking to prevent similar situation to happen in the future:
1. In case of report a violation, we will contact and inform brand registry team first, and finish the whole process with their help.
2.We promise to continue being a legitimate and cooperative IP owner on amazon, and abide by all rules and policies of the market to ensure the fair experience are provided to other amazon sellers.
3.We will continue using brand registry service to ensure a fair market for all sellers.
4.How will we abide Amazon's policy
l We will study IP for Right Owners, and will concentrate on learning and discussing the terms to avoid illegal operations regularly.
5.We also employ an independent IP law firm, to help us register copyrights, product patents and ensure our IP benefits. These steps include:
(1) register all necessary copyrights before list products
(2) if there is other seller infringe our copyright, we will ask law firm to handle with
(3) If we need to report a violation in brand registry, we will go through amazon IP for Right Owners again and ask brand registry before report
(4) Make sure the difference between copyright, trademark and patent
Since we joined the Amazon sales business, we have been actively learning operational knowledge and learning rules and policies. We also made some mistakes in the early stage, but we adjusted in time. Now we have been in business for Amazon for about XX years, and we have grown a lot. I believe, we will not break amazon IP for Right Owners in the future. I look forward to our growing together with Amazon.
I hope my mistake won’t cause my brand benefits to be revoked and that you can give me an opportunity to recover my brand benefits in the amazon.
